Active associate registrations at the ECB

The government is introducing a register in the Crossroads Bank for Enterprises (CBE) to combat social fraud, requiring construction and cleaning companies in Belgium to declare their active associates and helpers via the My Enterprise app from July 1, 2024. In a company, an “active partner” is any person holding at least one share who carries out a personal and effective activity within the company, without being declared as an employee for this activity. This includes self-employed people who combine the roles of agent (e.g. manager, director, corporate body) and active partner in the same company. Information to be provided includes surname, first name, national register number, and start and end dates. In terms of deadlines, data relating to the registration of active associates and caregivers must be communicated BEFORE they start work. The date of cessation of activities must be provided no later than fifteen days after cessation. Failure to comply may result in administrative fines of between 500 and 4,000 euros. This obligation could be extended to other sectors in the future.
